SoSe 14: (S) Usul al-fiqh in Muslim, Jewish and Christian Thought: Historical and Theoretical Perspectives

The course offers an ‘alternative’ introduction to u..l al-fiqh (commonly rendered as ‘Legal Methodology’, ‘Legal Hermeneutics’, ‘Legal Theory’) by laying the emphasis on its contribution to the advancement of theologico-philosophical reasoning and by taking on board its reception outside of Islam. The first three sessions will focus on the formation of u..l al-fiqh, both as a discipline and as a literary genre, and outline its major developments and trends in Muslim and non-Muslim religious thought from the 3rd/9th to the 7th/13th century. Each of the remaining sessions will single out one specific thematic point of intersection between u..l al-fiqh and other disciplines of theoretical knowledge, namely .ilm al-kal.m (the interplay between theological assumptions and hermeneutical strategies), falsafa (epistemology, theories of action and moral values, ethics), logic (status and forms of syllogistic reasoning), linguistics (grammatical thought; theories of meaning and signification, including pragmatics) and jurisprudence (concepts of authority, legal force, legal values). These sessions will be based on a close reading of select primary sources and pertinent scholarly literature (all texts will be made available in a reader at the beginning of the course). By the end of the course the participants should have acquired the taste and the tools for an adequate appreciation of u..l al-fiqh as an abundant repository of inquiries into core issues of philosophical and theological speculation within the three Abrahamic religions.
