This course is primarily focused on an in-depth reading of 'Towards Juristocracy' by Ran Hischl. In this book, Hirschl pursues a comprehensive comparative analysis of the political origins and legal consequences of different constitutional revolutions. He shows that constitutionalization is not aimed at democratization but a strategic instrument by threatened elites to preserve their hegemonic power. Next to the thorough engagement with the book, we will also read several contributions, i.e. Maznamayan (2015), Pocza (2018), Sadurski (2019), that discuss the judicialization thesis, judicial empowerment and different legal reforms in the context of countries in Eastern Europe.
