Kommentar
This course is concerned with examining the nature of constitutions as institutions. Informed by (new) institutionalism approaches and primarily but not exclusively focusing on Korea, this course deals with origin and change of constitutional ideas, norms, and adjudication. After having reflected on law, constitutions, institutions, and constitutions as institutions in general, the course considers various approaches to the phenomenon of origin and change of constitutions drawing on comparative constitutional law literature. In the latter half of the semester, theories and approaches will be applied to selected cases of legal norms, reform, and adjudication.
The course will be taught in English. Coursework will involve writing response papers and presenting and discussing in class based on literature and other sources in Korean or English. Students are required to be fluent in English and Korean (at least TOPIK-4). Schließen
