SoSe 20: Minority Rights

The purpose of this course is to understand the concept of minority rights and their constitutionalization. We will primarily engage with following questions: Why are minority rights included in constitutions? At what point in history started the inclusion, what influences the degree to which minority rights become part of the constitutional text (e.g. participatory constitution making), which types of rights are more likely to be included and which conditions support or hinder this inclusion. Drawing upon the rich body of literature on constitutionalism, democratic theory, identity formation and ethnic mobilization, this class sets out to expose — and challenge — the prevalent and elite-focused diffusion and accommodation idea of the constitutionalization of minority rights. It aims to replace it with a more realistic perspective on the political decisions and the bargaining behind constitutional design processes but even more so gives back a voice to the idea of empowerment and political action of minority groups through mobilization. The course is intended for students with an interest in constitutional law, political science, and history. close
