In this seminar we will explore the mediation and resolution of disputes in South Asia through locally grounded narratives. We are going to look primarily at the mechanisms that are used and the strategies that are employed by multiple actors to settle disputes. Apart from procedural and structural aspects , this also includes exploring how different actors conceive of justice, fairness, equality, equity and legitimacy in these dispute resolution processes.
The aim of the seminar is to better how legal and socio-political notions of justice converge in everyday dispute resolution practices in South Asia. We are going to look at the historical trajectory of these discussion as well as contemporary negotiations. Some topics that will be covered are the interaction between customary and informal, religious and state criminal justice systems, dispute resolution of honour killings/crimes of passion, marriage disputes and the recognition of grievances.
